Terms of Service

1. Definitions

"Service" means all websites, applications, software, AI systems, content, and features provided by Synapse. "AI Content" means any content generated through AI systems. "User Content" means all information, data, and submissions provided by a User.

2. Eligibility

The Service is not directed at, and is not intended to be used by, any individual under the age of thirteen (13) years. Users register on the basis of self-attested age information; a parent or guardian who believes a child has registered without appropriate consent should contact synapserewire@gmail.com. Synapse reserves the right to refuse registration, suspend access, or terminate accounts at its sole discretion.

3. Account Registration

Users agree to provide accurate, complete, and current information. Users are solely responsible for maintaining account confidentiality and assume full responsibility for all activities conducted through their account.

4. Description of Service

Synapse provides AI-powered productivity, habit-building, behavioral support, educational guidance, goal management, accountability tools, and related features. Service functionality may change without prior notice.

5. No Medical or Clinical Services

THE SERVICE DOES NOT PROVIDE MEDICAL CARE. Synapse is not a healthcare provider. Information provided is for informational, educational, and self-development purposes only. Users should seek qualified professional assistance for medical, psychological, or mental health concerns.

6. Crisis and Emergency Disclaimer

Synapse uses automated pattern-matching and an AI classifier to scan certain messages (check-ins and AI coach chats) for language suggesting self-harm or suicidal risk, and displays crisis-support resources (including KIRAN in India and 988 in the United States) when detected. THIS DETECTION IS AUTOMATED, IMPERFECT, AND NOT GUARANTEED TO CATCH EVERY INSTANCE — it must never be relied upon as a substitute for real emergency services. THE SERVICE IS NOT DESIGNED FOR EMERGENCY RESPONSE and does not monitor users in real time or dispatch emergency responders. Users experiencing thoughts of self-harm, suicide, violence, or immediate danger should immediately contact local emergency services or a crisis hotline directly.

7. Artificial Intelligence Disclosure

AI-generated outputs may contain inaccuracies, omissions, biases, or hallucinations. Users acknowledge that AI-generated content should not be relied upon as the sole basis for important decisions. Synapse does not guarantee accuracy or fitness of AI outputs.

8. User Content

Users retain ownership of User Content. Users grant Synapse a worldwide, non-exclusive, royalty-free license to host, process, analyze, and use User Content solely for operation and improvement of the Service. Confession, check-in, mood, and trigger-tracking content is not used to train AI models unless a user separately opts in, and is deleted from active systems within a defined period after account deletion, as detailed in the full Privacy Policy.

9. Prohibited Conduct

Users shall not: violate applicable laws; attempt unauthorized access; reverse engineer the Service; interfere with platform security; distribute malware; scrape or harvest data; impersonate another person; or use the Service for unlawful activity.

10. Intellectual Property

All Service components, software, designs, interfaces, trademarks, AI systems, and algorithms remain the exclusive property of Synapse. Users receive only a limited, revocable, non-transferable license to access the Service.

11. Fees, Subscriptions & Billing

Certain features may require payment. Fees may be modified at any time. Except where required by law, payments are non-refundable. Failure to pay may result in suspension or termination.

12. Third-Party Services

The Service may integrate with third-party providers. Synapse does not control third-party services and shall not be responsible for third-party content, actions, policies, or security incidents.

13. Privacy

Collection and processing of personal information is governed by the Privacy Policy. Users consent to processing, storage, and transfer of information necessary to provide the Service.

14. Termination

Synapse may suspend or terminate access at any time. Upon termination, licenses cease immediately. Liability limitations, indemnification, arbitration provisions, and IP protections survive termination.

15. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SYNAPSE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SYNAPSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. AGGREGATE LIABILITY SHALL NOT EXCEED USD $100 OR THE TOTAL AMOUNT PAID BY THE USER IN THE PRECEDING 12 MONTHS. Nothing in this clause limits liability for Synapse's gross negligence, willful misconduct, or fraud, or any liability that cannot lawfully be excluded under applicable law.

17. Indemnification

Users agree to defend, indemnify, and hold harmless Synapse from any claims, losses, liabilities, and legal fees arising from use of the Service, violation of these Terms, or infringement of third-party rights.

18. Force Majeure

Synapse shall not be liable for delays or failures caused by circumstances beyond reasonable control, including natural disasters, internet failures, cyberattacks, governmental actions, or other force majeure events.

19. Dispute Resolution & Arbitration

Any dispute arising from these Terms shall be resolved through binding arbitration. Users waive rights to jury trials and class action participation where legally permissible. Arbitration shall be conducted confidentially.

20. Governing Law

These Terms are governed by the laws of India for Indian users and by applicable United States federal and state law for United States users, as further detailed in the full Terms and Conditions. Any matter not subject to arbitration shall fall within the exclusive jurisdiction of competent courts as specified therein.

21. Data Protection Compliance

Synapse intends to comply with applicable privacy laws including the Digital Personal Data Protection Act, 2023; IT Act, 2000; IT Rules, 2021; GDPR where applicable; and CCPA/CPRA where applicable.

22–28. Additional Provisions

Synapse reserves the right to modify these Terms at any time. Continued use constitutes acceptance. Electronic acceptance (checkboxes, account creation) constitutes a valid electronic signature. Beta features are provided on an "as available" basis without warranties. No guarantee of uninterrupted service availability. User feedback grants Synapse a perpetual, royalty-free right to use and incorporate such feedback.

29–37. Final Provisions

Synapse may assign rights under these Terms without restriction. These Terms constitute the complete agreement between the parties. Export control compliance is the User's responsibility. Headings are for convenience only. Any rights not expressly granted are reserved exclusively by Synapse.

BY USING THE SERVICE, YOU ACKNOWLEDGE HAVING READ AND UNDERSTOOD THIS AGREEMENT IN ITS ENTIRETY AND VOLUNTARILY AGREE TO BE BOUND BY ITS TERMS.
